Expert evidence remains one of the areas where civil and common law traditions diverge most visibly. Yet, cross-border litigation and international arbitration increasingly demands that practitioners operate fluently across both.

This panel brings together dispute resolution lawyers from London and Paris, alongside experienced experts from Compass Lexecon. They will examine how each tradition approaches the instruction, independence, and cross-examination of experts, and how these differences play out in practice before national courts and international arbitration tribunals.

Drawing on experience from both contentious litigation and arbitration, the panel will consider where the traditions are learning from one another, where tensions persist, and how counsel and experts can work together more effectively.

The discussion aims to offer practical insights for practitioners regularly advising clients in cross-border matters, as well as a frank assessment of the challenges that remain.
