Trusts are facing increased scrutiny, and the challenges of managing them are becoming more complex. In this session, we’ll bring these issues to life with real world case examples and share practical insights on:

  • How to approach protector powers and the risk of deadlock, drawing on experience analysing the position in the Privy Council (the highest appeal court for many common-law jurisdictions).

  • Responding when capacity is weaponised, from our recent experience in numerous very delicate examples.
  • When lawyers become the target: The claims that can be brought against lawyers involved in setting up structures, and how to avoid being the target of those claims yourself.
