Turning the tables on hackers: Strategic tools for victims of hacking and fraud

This session explores how established civil causes of action and disclosure tools are being repurposed to investigate cyber enabled wrongdoing and recover digital assets internationally. It examines causes of action enabling early court intervention, including breach of confidence, data protection, economic torts and proprietary claims over assets and confidential data. We also look at the practicalities of identifying wrongdoers and tracing assets through disclosure mechanisms such as Norwich Pharmacal and Bankers Trust Orders, Model E disclosure and cross border tools including U.S. §1782 applications. Our presentation concludes with the practical realities of cyber disputes, emergency relief, parallel proceedings, enforcement challenges, and the ethical responsibilities of advisers operating in crisis situations.
Hugo is a Barrister at Brick Court Chambers, his practice has a particular focus on competition and commercial litigation, EU law, and environmental law. He is regularly instructed in leading and high-profile cases, including cases in each of The Lawyer’s Top 20 cases from 2016-2023, grappling with new legal issues and often leading to appeals. His practice encompasses a variety of areas: from complex transnational commercial disputes, to novel competition issues, and the law relating to climate change. He frequently appears in the High Court, the Competition Appeal Tribunal, the Court of Appeal and the Supreme Court, as well as the General Court of the EU and the Court of Justice of the EU, acting for private parties, government bodies and NGOs.
Dominic is a Partner in the Dispute Resolution team. His practice covers a broad range of commercial disputes for businesses and high-net-worth individuals. His cases are frequently complex, document heavy and involve multiple parties as well as a cross-border element and the need for emergency relief (e.g. freezing orders). He specialises in substantial civil fraud claims (notably data/computer hacking claims) and complicated multi-national, enforcement and asset tracing work.
