Energy Trading Disputes: Risk and Market Volatility

Trading is at the heart of energy sector activity. Recent years have seen an expansion in volumes, frequency and complexity. Also, market participants have assumed greater exposure, and counterparty relationships become more complex. These dynamics are generating new categories of disputes and heightening the stakes in existing ones.
Our proposed panel brings together leading advocates, economists and in-house counsel to examine critical dimensions shaping today's energy trading disputes landscape: (i) contractual risk in an environment marked by geopolitical shocks, sanctions, supply disruptions and market volatility; and (ii) common sources of trading disputes, including counterparty defaults, documentation failures, hedging mismatches and credit and margin issues.
Drawing on current cases and market practice, the panellists will offer practical guidance on managing resilience and navigating the compliance, regulatory and reputational risks that accompany increased trading activity.
Participants will leave with understanding the need for actionable strategies to manage uncertainty and strengthen contractual protections, best-practice approaches to valuation and loss quantification in disrupted markets, and insight into the particular risks and dispute trends shaping energy trading today.
