Reasonable certainty or full reparation? This is the dilemma Tribunals face when assessing damages in early-stage projects and ventures. Where potential exists but steady operations do not yet, Tribunals struggle with whether and how to award damages. Should they assume a promised ability to generate profits or remain sceptical? What methods can capture the value of a potential future yet properly account for risk? In the end, how can Tribunals avoid the twin errors of credulous speculation on one side, and bleak pessimism on the other, and arrive at a reasoned and reasonable damages award? This panel will explore these questions and make suggestions towards solving the dilemma.
