Employee Competition across Borders: team moves; confidential information; and restraint of trade

3 Jun 09:00 - 10:30

Employment

Panel discussion covering the key issues and considerations of Employee Competition across Borders: team moves; confidential information; and restraint of trade.

When a key team decamps to a competitor, or confidential information walks out of the door, the fallout is not always confined to a single jurisdiction. The commercial pressure to act quickly may collide with the complexity of coordinating proceedings strategically across multiple jurisdictions.

In this session, chaired by the Honourable Mr Justice Mansfield, Lewis Silkin and 11KBW will be joined by Tom Potbury, Head of Employment Law, EMEA and APAC at Aon, and Kristin Byng Nelson, General Counsel at Ardonagh Specialty to examine how cross-border employee competition and confidential information disputes play out in practice, and how threats are managed strategically across jurisdictions where the available protections vary. In particular, the session will explore the practical challenges of responding to team moves across borders, the protection and misuse of confidential information in an international context, and of managing restraints of trade in an international workforce.

The panel will examine these issues from both sides of the instruction: the private practice lawyers who litigate in this space, and the in-house lawyers who manage and respond to these risks within their business.
