Digital Assets: New Frontiers of Professional Liability

Digital assets remain somewhat of an enigma. The combination of decentralisation across borders, permissionless access, and self-enforcement of rules through code and economic incentives gives rise to characteristics and phenomena not previously encountered before in other kinds of personal property. But they are no longer a niche interest of hobbyists, early-adopters and nefarious actors. Digital assets, in their various forms, and the technology underpinning them, are now well on their way to gaining institutional adoption. More sophisticated investors and market participants means more opportunities for professional advisors. However, those opportunities come hand in hand with risks.
This session will explore what unique or heightened risks of professional liability arise for those advising clients in this still-novel, fast-paced, and fascinating space.
