Commercial parties often assume that their contractual limitation and exclusion clauses will hold – but that is not always the case. This seminar examines when contractual constraints on liability are likely to be upheld, and when they may fail as a matter of construction or as a result of the Unfair Contract Terms Act 1977 (UCTA) (spoiler – UCTA bites harder and more often than you might expect).
