This panel will contrast the economics of fintech business models with those of traditional financial services firms and explore recurring themes in damages assessments, including scaling and monetisation patterns, platform economics, regulatory scrutiny, and market sentiment. Through a detailed case study, we examine how traditional valuation methodologies are applied — and adjusted where appropriate — to reflect the distinctive features of fintech businesses. Drawing on the perspectives of counsel and arbitrators, the panel will consider how courts and tribunals are likely to approach complex valuation questions in a rapidly evolving sector with a limited body of decided cases.
