An interactive panel discussion exploring the behavioural dynamics that influence how parties approach, escalate, and resolve disputes arising from post M&A and JV transactions, drawing on panel members’ expertise and experiences. This will include examining the impact of cognitive biases (such as anchoring, myside/confirmation bias, and the sunk cost fallacy) barriers to settlement, including ego, loss aversion, and reputational concerns, and the potential role for AI agents as negotiators or negotiating aids, building on fascinating live research on this topic.
