This session will explore the distinct challenges of litigating cases in the life science sector, focusing on the critical interplay between liability and quantum. When collaborations or supply agreements break down, allegations of non-compliance with regulatory or technical specifications or a failure to secure approvals are often at the heart of claims for damage. These disputes raise difficult questions around causation, counterfactuals, and valuation. This session will examine how to address such issues and discuss methodologies for assessing reasonable royalties, lost profits, and negotiating damages within the particular economic and regulatory context of the life sciences industry.
