Arbitration used to sell itself as being a more robust and more efficient dispute resolution procedure than litigation – is any of that true anymore?

 

Arbitration is more popular than ever, but scepticism also seems to be growing. There are more complaints than ever about the speed and cost of the procedure, as well as the quality of decision making. How valid are these concerns? Is the case for arbitration becoming weaker?

 

The panel will consider these questions from two perspectives – the perspective of the London based practitioner and the India based practitioner. While the experience of arbitration in these two countries historically has been quite different, there seems to be more in common between the London view of arbitration and the Indian view of arbitration in 2026. A panel consisting of a prominent India-based arbitrator, London and India based disputes specialists, and an English KC will address whether changes are necessary in order for arbitration to continue to thrive.
