20 Years of the CBIR: the Perks and Pitfalls of Cross-border Insolvency Recognition

3 Jun 09:00 - 10:30

Fraud & Asset Recovery, Restructuring & Insolvency

Please join our exceptional panel for a practical, frank and multi-jurisdictional discussion of the advantages and difficulties of cross-border recognition of insolvency proceedings. Representatives from Maitland and Stephenson Harwood will be joined by Sarah Latham of Ogier BVI, with tips and tricks from the Caribbean, and David Standish of Interpath, to offer up an IP's perspective.

Cross-border recognition is a critical stage in international dispute resolution involving insolvency proceedings. England's adoption of the Model Law via the Cross-Border Insolvency Regulation in 2006 transformed the landscape domestically but traditional common law recognition remains alive and well, sitting alongside other statutory gateways to provide insolvency practitioners with a flexible toolkit to remedy wrongdoing in multi-jurisdictional insolvencies. Our event will offer comparative discussion of the processes in the BVI and England, with our experienced panel discussing how they have utilised recognition processes globally as part of their dispute resolution strategy.
