This panel will explore the growing role of arbitration in resolving FRAND disputes, whether it offers a more efficient and coordinated alternative to multi-jurisdictional litigation and the potential impact of the Court of Appeal’s recent decision in Acer and Asus v Nokia on arbitrating FRAND disputes. The panel will discuss the advantages and challenges of resolving FRAND disputes through arbitration, including confidentiality, tribunal expertise, and enforceability under the New York Convention, as well as practical considerations for disputes that have traditionally been litigated in national courts.
