Multi-jurisdictional enforcement of arbitration awards and issues of State immunity

This panel will consider the latest developments in the enforcement of arbitral awards with a particular focus on the case of Zhongshan Fucheng Industrial Investment Co. Ltd. v. Federal Republic of Nigeria and the enforcement of an award made in that case against Nigeria. The panel will explore enforcement in the US, France and the UK, as well as general trends in the enforcement of awards made against States.
The panel will consider whether States are becoming more resistant to enforcement and practical steps that investors can take to mitigate country risk and increase the likelihood of enforcement.
The panel will also consider the recent decision of the UK Supreme Court in The Kingdom of Spain (Appellant) v Infrastructure Services Luxembourg S.À.R.L. and another (Respondents) and Republic of Zimbabwe (Appellant) v Border Timbers Ltd and another (Respondents) which upheld the recognition of awards against Spain and Zimbabwe.
