Minds vs. Machines: AI’s Promise and Limits in Arbitration

The session adopts a hearing-style structure inspired by prior “Minds vs. Machines” programs: counsel argue opposing positions before a tribunal, which issues a non-binding determination.
AI tools are increasingly used in arbitrator analytics, conflict checks, and predictive modelling.
But should algorithmic systems influence — or determine — arbitrator selection?
This session frames the issue as a live dispute.
Proposition: AI-assisted selection enhances neutrality, diversity, and efficiency.
Opposition: Algorithmic opacity threatens legitimacy, due process, and party autonomy.
Counsel will argue before a three-member tribunal. The tribunal will deliver a short reasoned “award” addressing:
• Independence and impartiality
• Equality of arms
• Transparency and explainability
• Bias in training data
• Challenge and enforcement implications
The audience will vote before and after the award to measure persuasion shift.
