Cross-border employee competition disputes are increasingly common as teams move between global businesses, so too is the use of arbitration to resolve fast-paced business protection disputes.

 

This session examines the evolving landscape of business protection disputes, from questions of choice of dispute resolution forum, submission to foreign courts, to jurisdiction challenges and the practical realities of gathering evidence and navigating foreign law. We will explore recent trends in team-move litigation and the strategic considerations that arise where departures have an international dimension. Drawing on the High Court’s decision in Guy Carpenter & Company Ltd v Willis Ltd, the panel will discuss how courts are approaching large-scale recruitment disputes and what it means for employers seeking urgent injunctive relief.
