Cross-border investigations become significantly more complex as geopolitical tensions increase. Corporates and counsel face growing challenges around data localisation laws, state secrecy concerns, export controls and restrictions on transferring digital evidence across borders. 

This session will explore practical approaches to conduct investigations and disputes involving multiple jurisdictions, guided by a case study. The panel will cover issues such as navigating digital forensic collections in restricted jurisdictions, managing cross-border data transfer risks and using artificial intelligence (AI)-enabled analytics and technology platforms to review and analyse large volumes of data efficiently while maintaining defensibility. Drawing on recent investigations and disputes experience across the US, Europe, the Middle East, Asia and Australia, panelists will discuss how legal teams are adapting eDiscovery and review strategies, including the use of generative AI, to manage regulatory scrutiny and increasing data volumes.
