As geopolitical tensions increase, cross-border investigations have become significantly more complex. Corporates and counsel are facing growing challenges around data localisation laws, state secrecy concerns, export controls, and restrictions on transferring digital evidence across borders.
This session, guided by a case-study, will explore practical approaches to conducting investigations and disputes involving multiple jurisdictions. The panel will cover issues such as navigating digital forensic collections in restricted jurisdictions, managing cross-border data transfer risks, and using AI-enabled analytics and technology platforms to efficiently review and analyse large volumes of data while maintaining defensibility. Drawing on recent investigations and disputes experience across the US, Europe, Middle East, Asia and Australia, we will discuss how legal teams are adapting their eDiscovery and review strategies - including the use of generative AI - to manage regulatory scrutiny and increasing data volumes.
