In this session, the panel will address problems arising in litigation and arbitration where there are concerns as to the ability to enforce a judgment or award. They will discuss the measures available to find and secure assets before, during and after litigation/arbitration and the steps available to parties to ensure compliance with any protective measures granted by the court or tribunal. The discussion will include an exploration of the circumstances in which a national court's penal processes can be used to remedy breaches of protective measures and the procedural issues arising in such situations.
