As competition for talent intensifies, the rise of large-scale and fast-moving team moves across jurisdictions is causing disputes involving the misuse of confidential information to become increasingly commonplace. These disputes involve not only complex analysis of restrictive covenants, but also ever more decisive questions of forum, remedy and evidence-gathering across borders.
Bringing together market-leading practitioners from the UK and the US to provide specialist insight on how these disputes unfold in real time, this session will examine:
- The first 72 hours: The immediate steps which clients should take to respond to team moves, including preserving evidence, conducting investigations and formulating litigation strategies.
- Cross-border perspectives: How to coordinate parallel proceedings across the UK and US, including forum selection and sequencing across complex and varied procedural and evidential regimes.
