The India-UAE BIT: New Protections & Strategic Opportunities for Indian Corporates

The strategic corridor between India and the UAE has entered a new era. The dual activation of the 2024 India-UAE BIT and the Comprehensive Economic Partnership Agreement (CEPA) has created a sophisticated "Shield and Sword" framework for Indian outbound investment. The CEPA offers opportunities for Indian companies in key sectors including Agri-tech and Food Security, Renewables and Digital Infrastructure whilst the BIT provides critical investment protection. Indian companies wishing to benefit from this new landscape also need to grapple with sometimes complex questions regarding Investor-State Dispute Settlement (ISDS), regulatory carve-outs, and jurisdictional strategy. This session will look beyond the policy highlights and discuss the legal and operational realities of the new framework.
