This session will explore how commercial courts are responding to the realities of increasingly transnational commerce and litigation. As disputes frequently span multiple jurisdictions, courts are engaging in greater dialogue, cooperation and procedural alignment to address the challenges of cross-border disputes. The second part of the discussion will consider the evolving role of commercial courts within this landscape and how judicial engagement and private law innovation may contribute to greater predictability in cross-border litigation.
