Art Law - Is a Specialised Dispute Resolution Forum Needed?

The work of resolving disputes involving art and cultural property typically falls to a specialist group of lawyers and art market experts. Initiatives such as the Court of Arbitration for Art and the World Intellectual Property Organisation Alternative Dispute Resolution for Art and Cultural Heritage Service have tried to harness this and provided a one-stop shop to resolve art law disputes but have met with limited success. What really differentiates art law disputes from other types of commercial and business matters? Does the nature of assets at the heart of these disputes require specialist treatment in dedicated dispute resolution forums? Why are specialist arbitration models yet to get off the ground? This seminar will explore these questions and others with a group of leading art lawyers in private practice, in-house and at the Bar drawing on insights from key perspective across the art market.
