As investment in sport continues to grow, the financial consequences of court or arbitral findings in sports law litigation take on ever-greater importance.
This session anticipates the rise in “follow-on” litigation that is likely to emerge from the recent spate of significant sports law decisions on breaches of financial fair play, unlawful transfer regulations, and the on-field sanctions imposed as a result. The discussion will consider how regulatory disputes and decisions may give rise to consequential third-party ‘loss of a chance’- type claims, the legal principles that underpin such claims, the evidence needed to value, advance and defend them, and the practical challenges that such claims pose for parties and regulators alike. The aim is to provide a clear and practical overview of why and how follow-on claims may shape the next frontier of sports-related disputes.
