Infrastructure projects across the world are increasingly being delivered in an environment shaped by geopolitical instability, armed conflict, economic sanctions, and disrupted supply chains. These pressures are placing unprecedented strain on major construction and energy projects, often giving rise to complex disputes involving delay, disruption, cost escalation, and questions of causation.
At the centre of these disputes lies the challenge of establishing facts and technical evidence. Tribunals are frequently required to assess complex engineering issues, programme analysis, quantum assessments, and the impact of external geopolitical events on project delivery.
This panel will examine the critical role of technical experts in helping tribunals navigate these issues. Bringing together a technical expert, arbitration counsel, and disputes practitioners, the discussion will explore how expert evidence is developed, tested, and presented in disputes arising from projects affected by geopolitical uncertainty and conflict. The session will also consider how collaboration between legal teams and technical specialists can ensure that complex technical realities are clearly and effectively communicated in international arbitration.
