The panel will explore recent developments and jurisdictional complexities impacting cross border matters in the context of global patent licensing disputes, with a particular focus on interim licence declarations in the UK, court acceptance of jurisdiction to undertake global licensing determinations without party consent more generally, and the cross-border implications for related proceedings in the USA, India, Germany and more widely across Europe before the Unified Patents Court.

Event description:

Following the judgment of the High Court of England & Wales in Unwired Planet v Huawei demonstrating a willingness of England & Wales as a jurisdiction to both set the value and terms of a global patent portfolio licence, significant jurisdictional disputes have arisen in cross-border patent matters over the appropriate jurisdiction (if any) to adjudicate on these issues. Disputes have been significantly heightened following England & Wales allowing claims for declarations of an interim licence, and the impact (perceived or otherwise) of this on pending proceedings in other jurisdictions.  The panel, with significant experience of these matters within their own jurisdictions and working on these matters across borders, will address where this has now taken multijurisdictional litigation, and the implications for the teams managing these matters.
