  • Directors’ duties : The Court of Appeal’s decision in Saxon Woods v Costa has reopened the debate over whether the core duty to promote the success of the company is subjective or objective. With the Supreme Court hearing imminent, this is an area to watch closely.
  • Creditor interests: Sequana provided welcome guidance on the duty to consider creditor interests near insolvency, but with a number of significant questions remaining open, where will the next wave of creditor-duty litigation land?
  • Derivative and shareholder claims: Has the statutory derivative procedure fulfilled its potential?
