Which way out? A new wave of shareholder, transaction and joint venture disputes, driven by recent market and valuation trends

Various financial and economic trends (inflation, interest rates ‘higher for longer’, valuations) are affecting deal dynamics and prompting parties, particularly PE investors, to question original investment plans and ask whether an alternative exit is available. In order to maximise value, rights in shareholder agreements and SPAs are exercised and disputes triggered which were unlikely to have been considered at the outset of the deal. This session will examine the underlying trends, explore the typical rights that are being exercised and ways in which these disputes are being litigated and resolved.
