Breaches of Dams and Duties: managing the “irredeemably unmanageable” in modern group litigation
4 Jun 14:00 - 15:30
Drawing on their experience in major group litigation such as Municipio de Mariana v BHP and Various Claimants v Hargreaves Lansdown, the panel will explore the challenges of managing cases and clients in the grand-scale commercial group litigation increasingly seen in the English courts. The discussion will examine whether the courts' existing tools of case management remain fit for purpose for the largest and most complex claims, and how, in practice, courts, parties, litigators and others can navigate the perils and pitfalls that arise in managing behemoth proceedings from pre-action through to judgment.
