Costs and Litigation Funding underpin all forms of dispute resolution, but the law of costs is growing increasingly complex and managing clients’ expectations – whether in respect of their own legal spend, recovery of that spend, or liability for an opponent’s costs – is becoming ever more difficult. Good, early and accurate costs advice can have a significant impact on the ability to earn and maintain a clients’ trust and increase law firm profitability. Getting it wrong can transform success in the litigation/arbitration into a failure in client satisfaction and retention. The AI revolution is already increasing the appetite to review and challenge legal spend and ‘value’. This engaging session will explore how an early and effective strategy towards litigation funding and legal costs can positively affect the lawyer-client relationship, as well as considering common pitfalls and traps for the unwary which can put pressure on that relationship and risk a current client becoming the next opponent.
