Has the Hanover Shoe dropped? The implications of the interchange pass-on judgment for indirect, consumer and collective competition claims.

4 Jun 09:00 - 10:30

Antitrust & Competition, Damages

The panel will discuss the Trial 2 pass-on judgment in the Interchange proceedings, in which each of the firms on the panel were involved, the clarification of the test for causation in establishing pass-on, and its ramifications for multi-level supply chain and consumer claims. The panel will reflect on the factual and expert evidence necessary to succeed in claims before the Competition Appeal Tribunal, as well as the latest related developments in the case law (Evans, CICC (opt-in) etc.) and how developments elsewhere (the Department for Business and Trade’s review of call for evidence on the opt-out collective action regime) may impact business and consumer collective competition actions.
