In this session we will cover: 

  • the key drivers of commercial disputes on traditional renewable energy projects – technology failures, under-performance, delay and cost increases;
  • the types of claims likely to arise on emerging renewables projects – including hydrogen disputes, disputes arising out of the repowering of ageing renewables infrastructure and the enhancement of fossil-fuel fired and/or traditional renewable energy sources to incorporate battery storage and carbon capture technology;
  • the potential sources of investment treaty disputes in the renewables sector and how to maximise public international law protection; Practical tips and tricks for ensuring cost-effectiveness and efficiency in related arbitration proceedings; and
  • the practical questions that you should be asking yourself to understand if you have a good claim and whether you should pursue a formal dispute or settle amicably.
