Recent developments in anti suit injunctions: Russian counter sanctions and issues arising under the New York Convention

Following the invasion of Ukraine in 2022 Russia has enacted a range of sanctions which the interests of western businesses which allow Russian Courts to disregard valid jurisdictional and arbitral bargains. Article 248 of the Russian Arbitrazh Procedural Code has changed the landscape of international dispute resolution. The panel will consider recent anti-suit injunction decisions arising from Article 428 including Google LLC & Anor v NAO Tsargrad Media & Ors [2025] EWHC 94 (Comm).
If a party seeks partial recognition of an arbitral award in State A can a claimant seeks anti-suit injunctive relief preventing the furtherance of those proceedings, under the New York Convention, on the grounds that they are a disguised challenge to the substance of the award or can partial non recognition of the award be obtained under the New York Convention.
This panel discusses the risks and potential responses available to effected parties in courts and in arbitration including anti suit injunctions, emergency arbitrations and enforcement strategies.
