Public International Law and Sanctions In the context of Arbitration
4 Jun
11:00 - 12:30
As states increasingly resort to economic and trade sanctions as an instrument of foreign policy, their impact on commercial transactions and the adjudication of the multi-jurisdictional disputes is being increasingly felt. Sanctions can have an effect not only on the conduct of business itself, but also the resolution of disputes arising out of, commercial relationships impacted by sanctions. These are matters of concern not only to the immediate parties themselves, but all persons involved in the arbitration process. This proposed panel will touch upon a number of issues of interest to practitioners and users of international arbitration seeking efficient dispute resolution while navigating the complex and precarious sanctions landscape.
Key topics to be discussed will include:
• Impact of sanctions on the procedure and conduct of commercial arbitration
• Public international law issues in arbitration
• UK licensing concerning legal services and arbitration
• Private international law, sanctions and sanctions countermeasures
• Sanctions, investor protection and arbitration
