The recent developments in artificial intelligence and machine learning have led to a tremendous increase in the amount of individual data and information harvested and available, with implications for IP rights and collective actions. On the one hand, there is the issue of where and how to bring legal action, as the choice of venue can have implications for the case, such as the applicable rules and procedures and the potential costs involved. On the other hand, there is the fundamental question of how to establish a value for individual data, starting from the creation of a flexible framework which would encompass the heterogeneous nature of these types of data, and the multiple uses to which it is put. This panel of legal and economic experts will discuss these questions, starting from the direction of travel emerging from recent decisions.
